The cost of a trademark application in India depends on the applicant’s category, the number of marks and classes, and the professional assistance selected. Before paying, understand which charges cover government filing and which cover the service provider’s work.

A clear quotation should show the initial amount payable and explain any services that may attract additional charges later.

Government Fees for Trademark Applications

For a standard online trademark application using Form TM-A, the government filing fees are:

Applicant category Government e-filing fee per mark per class
Individual ₹4,500
Eligible startup or small enterprise ₹4,500
Other applicants ₹9,000

A company or LLP should not automatically assume it must pay the higher fee. Check whether it qualifies under the applicable startup or small enterprise category and can provide the required supporting evidence.

Government fees can change. Confirm the applicable amount using the official IP India fee schedule before filing.

Why the Number of Classes Affects the Cost

Trademark applications identify the goods or services for which registration is sought. If your application covers more than one class, government filing fees apply for each class.

For example, an eligible individual applying for one mark in two classes would pay ₹9,000 in government e-filing fees. An applicant in the ₹9,000 category would pay ₹18,000 for one mark in two classes.

These figures exclude professional charges and any applicable taxes on those services.

What Are Professional Charges?

Professional charges are the fees a private service provider charges for its agreed work. Depending on the package, this may include:

  • Search assistance.

  • Help identifying relevant trademark classes.

  • Collection and review of application information.

  • Document preparation.

  • Application filing assistance.

  • Sharing filing acknowledgements and status updates.

The scope varies between providers. Ask for written confirmation of what your selected package includes before making payment.

Does the Initial Price Cover the Entire Process?

An application filing package does not necessarily cover every later stage.

An examination report, hearing or opposition may require additional work. Before engaging a provider, ask whether responses, hearing attendance and opposition-related assistance are included or quoted separately.

Also distinguish between a professional charge for additional work and an official fee for a particular application or proceeding. They are separate expenses.

Check Taxes and the Total Payable

Do not compare packages using only the headline price. Request a breakdown showing:

  • Professional charges.

  • Applicable taxes on professional services.

  • Government filing fees.

  • Any other agreed expenses.

  • The total initial amount payable.

If government fees are paid separately, confirm who will make that payment and how you will receive the acknowledgement.

Questions to Ask Before Making Payment

Before approving your quotation, check:

  1. Does it cover the correct applicant category?

  2. How many marks and classes are included?

  3. Are taxes and government fees included?

  4. What work is excluded?

  5. Will additional work require your approval before charges arise?

  6. What cancellation and refund terms apply?

Keep the quotation, invoice, payment receipt and application acknowledgement for your records.
